If you are a Ukrainian citizen currently present in the United States and are worried about your visa expiring (or if it already has), don't be afraid. While the crisis is tragic, and our hearts go out to everyone in Ukraine right now, it is not a time without hope. Most Ukrainians in the U.S. are eligible for protection under U.S. Immigration Laws, including paths to eventual citizenship.
The most powerful option, asylum, has complicated rules and strict timelines, but with the right guidance, you can navigate the process and find peace and security in the U.S. Once approved, you may even be able to have family members trapped abroad join you here.
Read below for general information, or call our office at (209) 408-0104 to schedule a consultation with an experienced immigration attorney.
We understand the importance of what we do, and strive to provide caring, supportive attention during these trying times. With a small, dedicated team that cares deeply for each of our clients, we stand ready to help you seek safety and security as you navigate the complex U.S. immigration system.
The U.S. Asylum System may be complex and intimidating, but it provides safety and security to tens of thousands of people fleeing violence and persecution every year. If you are a Ukrainian citizen who fears for your safety if they return to Ukraine and falls into any of the following categories, you may qualify for asylum in the U.S.:
Please be aware that asylum is neither fast nor easy. Not everyone who meets the above categories will be approved, and it is very important that your case be evaluated by an experienced immigration attorney who understands the nuances of what makes for a strong or weak case. It is not unusual for two brothers with very similar histories to talk to an attorney and find out that one brother has a strong case and the other one doesn't qualify.
To find out if you qualify, you should contact an experienced immigration attorney who can make sure you qualify and guide you through the process. Contact us at (209) 535-3104 to set up an appointment for an consultation.
Asylum is not the only option. When you speak to an immigration attorney, make sure that they listen to your whole history and check whether you might be eligible for other options, such as a family petition, re-opening of an old immigration case, or other alternatives to asylum.
There is some hope that President Biden will add Ukraine to the list of countries covered by Temporary Protected Status as well, but that has not been confirmed. This would be an amazing benefit, and one that a lot of us are hoping for right now.
